Part A: How to enter and participate in the competition
Definitions:
“Competition”: General knowledge quiz titled “Kaun Banega Crorepati (2007 series)” and on air referred to as “Kaun Banega Crorepati.”
“Company”: STAR India Private Limited, the organizer of the competition.
“Contestant(s)”: Any person(s) who is eighteen (18) years and above of age, is a citizen of India and is resident of India (as per the definition of “resident” in the Income Tax Act, 1961) and has not been in the Hot Seat in the series of “Kaun Banega Crorepati,” and enters the competition in accordance with the rules stated below.
“Fastest-Finger first” means that part of the show/episode of Kaun Banega Crorepati (2007 series) where the same question is asked to the selected contestants, who in turn shall answer the same. The first person to correctly answer the question shall be entitled to proceed to the Hot Seat.
“Hot Seat” means the winner(s) of Fastest-Finger first and who sits before the host of the Competition to participate further in the Show.
“Lifelines”: The four methods of assisting the Contestants during the show namely “50/50″ option, “Phone a Friend” option, “Ask the Audience” option and “Flip/Exchange” option, the precise details of the option and method of use will be explained in detail during each Show.
“Programme”: The recordings of the Competition in the Studio (including any seasonal special/s recording).
“Quota-1″ means 5% from each zone (i.e. Zone 1 to Zone 10, more particularly detailed in the General rules hereinbelow).
“Quota-2″ means at least 10% from each zone (i.e., Zone A, Zone B, Zone C and Zone D, more particularly detailed in the General Rules hereinbelow), at least 20% for women and at least 20% for people between 18-35 years of age.
“Quota – 3″ means at least 1 person from each zone (i.e., Zone A, Zone B, Zone C and Zone D, more particularly detailed in the General Rules hereinbelow), at least 1 woman and at least one person between 18-35 years of age.
“Seasonal special/s”: Any episode/s of the Show (defined below) specially recorded to celebrate a specific time of year.
“Schedule”: an episode or a set of episodes to be recorded and/or recording dates as pre-determined by the Company.
“Show”: Each episode of the Programme (including any seasonal special/s episode/s).
“Show Number and Date”: The number and date of recording of the Show in question.
“Special episode/s”: Any episode/s of the Programme recorded with Contestants who belong to a category other than that specified hereunder, which may include celebrities or children special, or any other category which may be decided upon by the Company in its sole discretion. Such episodes may have additional rules (as amendments/attachments) to which the Contestants will have to comply with along with all the other rules of the Competition
“State Special/s”: Any episode of the Programme recorded with the Contestants from only a particular state/s.
“Studio”: Studio No. 7, Maharashtra Film Stage and Cultural Development Corporation Limited, Film City, Goregaon (East) Mumbai-4000 65 or any such other studio as the Company may nominate.
“Studio Part”: That part of the Competition, which takes place in the studio whether or not recorded for transmission.
1. Procedure to participate in the Competition:
(a) The Contestant(s) can register his/her telephone number to participate in the Competition by dialing number 190442478270 1/2/3/4, depending on the Contestant’s option for the question.
(b) The Contestants can register his/her telephone number to participate in the Competition by dialing the number stated above and punching the answer to the question asked in the on-air promos. On dialing the number (stated below) and punching the answer the telephone number from which the Contestant has called gets registered with the Company.
(c) The Contestants can register his/her Airtel number to participate in the Competition by calling number 5646 1/2/3/4 depending on the Contestant’s option or via SMS: SMS “KBC” to 5646 1/2/3/4, depending on the Contestant’s option.
(d) The telephone lines and the mobile lines and SMS acceptance shall be open for each Show from 8:00 pm (IST) to next day 7:00 pm (IST) only. From January 22, 2007 the telephone lines and mobile lines and SMS acceptance shall be open of each Show from 10.00 pm (IST) to next day 8.00 pm (IST). In case the calls and/or SMS are made after the lines have closed the said entry(ies) shall not be valid
(e) Incase one (1) or more than one (1) entry from a particular telephone number is received by the Company, in such a case when the Company calls up that particular telephone number and the person who answers the call confirms that he/she is the person who has answered the question correctly, it shall be accepted by the Company.
(f) Calls made by Contestant(s) from BSNL and MTNL telephone lines only shall be considered as valid entry. Further calls made from PCO, office board lines (EPABX or by any other system) and any other telephone lines shall not be valid entry to participate in the Competition.
(g) Telephony, i.e., via landline, mobile (i.e., voice and/or SMS) is the only method by which a Contestant can enter the Competition. Nevertheless the Company reserves the right to introduce any other method/scheme/contest by which Contestants may enter the Competition.
2. Call costs and helpline:
The call cost to the callers calling in from BSNL or MTNL shall be charged 2 pulses per call; Rs. 2.40 per sms and Rs. 2.40 per call for Airtel callers. This does not include roaming charges.
ROUND 1:
The Contestants will be required to punch in the answer to the question asked in the on-air promos for particular episode in case the answer of the Contestant is correct the telephone number will get registered with the Company.
3. Upon entry to the competition:
ROUND 2:
(a) If the Contestant(s) answer is correct and the telephone number is one of the three hundred and forty (340) hundred correct entries who have been selected through computer random selection, (After the application of a Quota-1 as defined above) the Company will call up on the telephone number registered with the Company. In order to qualify to participate in the Competition, the Contestant(s) will be asked personal details (i.e. full name, permanent present residence address, date of birth) and information to check the eligibility of the Contestant to participate further, an alternate telephone number will be asked for by the Company, however, the Contestant(s) is required to make himself/herself available at all times on the telephone number registered with the Company, and the Contestant must be available to be present in Mumbai for recording for that particular Show on that particular day (“Agreed Show Date”), in case the Contestant will not be available for the recording on the Agreed Date and/or is not eligible as per the General Rules, the Contestant will be disqualified, The said conversation between the Company and the Contestant(s) may be recorded (solely at Company’s discretion) in case the information provided by the Contestant(s) is considered to be appropriate by the Company, two (2) questions shall be asked to the Contestant(s) to qualify for Round 3. Following which the Contestant will be informed approximately the number of days and time during which the Contestant will receive a call from the Company, provided the question is correctly answered by the Contestant(s).
(b) In the event Company is unable to meet the Quota-2, Company reserves the right to select further one hundred and sixty (160) correct entries who have been selected through computer random selection process. However, if the Company is still unable to meet the Quota-2 requirement, Company reserves the right to select another initiate another round of selection process from the correct entries which have been selected through computer random selection process.
ROUND 3:
In case the answer is correct to the question in Round 2 and the Contestant is one of the hundred (100) correct entries, who has been selected through computer random selection The Contestant(s) will be asked three (3) close ended general knowledge questions and one (1) “nearest to” question. The final Contestants shall be told the date and approximate time when Contestants will be telephoned again in the event of their successfully answering the general knowledge question(s) so as to arrange for their attendance on the Agreed Show Date.
Quota 2 process shall be applied to the 100 correct entries of the Contestants shall be short-listed by computer random selection process (This process will be completed in respect of each contest following the closure of the lines for that Show).
a) In the event that a Contestant’s name is selected such Contestant will be telephoned on the telephone number provided, on the day indicated in the initial phone message. The Company shall make upto three attempts over two (2) days to contact each of the short listed Contestants. If successful contact is made the telephone conversation will be recorded and Contestants will:
(i) Be asked to re-confirm first that they will comply with the rules (and be advised of where to obtain copies if required) and, second, reconfirm whether the Contestant will be available for the Agreed Show Date (and that they agree to participate in the following contest in Round 3, as the case may be). In case for whatever reason the Agreed Show Date was not correctly heard by the Contestant and the Contestant cannot attend on the Agreed Show Date in question, the Company will regretfully be unable to offer an alternative show date.
(ii) Ten (10) Contestants shall be allowed to participate in the Studio part of the Competition, of which up to five (05) Contestants shall be brought forward from Kaun Banega Crorepati 2 (who were selected by the Company but unable to participate because of discontinuity of the Programme by the Company), the balance Contestants will be selected from Kaun Banega Crorepati (2007 series). In the selection process prior to the Studio Part of the Competition, the Quota-3 process shall be applied to the balance Contestants who have been selected from Kaun Banega Crorepati (2007 series) The Company reserves the right to change the episode numbers in which the Contestant from the Fast Lane to Kaun Banega Crorepati (2007 series) shall participate in the Studio Part, without any prior intimation to the concerned Contestant and/or to the public.
(iii) Ten (10) Contestants in respect of each Show shall be selected on the basis of response to the questions and as per the Quota processes stated herein and also the rules and conditions stated herein and will be asked to participate in the Studio Part of the Competition, subject to the fulfillment of the conditions and of the rules.
(iv) Each of the ten (10) Contestants shall be required to send the necessary documentation (as stated in the General Rules) to confirm the details given by the said Contestant in the rounds. In case the said Contestant is unable to send the necessary documentation the said Contestant shall be disqualified by the Company.
b) Upon successful contact and agreement with the Contestants as to the arrangements for such Contestants attendance at the Studio:
(i) Contestants must attend the Studio at the time communicated by the Company on the Agreed Show Date.
(ii) Contestants must bring one relative or friend for the Studio Part of the Competition.
(iii) The reasonable travelling and any other agreed necessary expenses of both the Contestant and his/her friend will be reimbursed. For outstation guests, the Company will pay on actuals on travel upto a maximum of Economy class air fare or 2nd AC rail fares from the city of their residence to Mumbai and back, plus boarding and lodging as arranged by the Company in Mumbai for the Contestant and his/her friend. No other costs or fee will be paid for any attendance at the Studio or in respect of any loss of earnings thereby incurred.
c) In the event of the failure of any Contestant to attend the Studio by the aforesaid time for any reason whatsoever the Company shall be entitled to exclude such Contestant(s) from the Show and the Studio Part of the Competition.
d) There will be (Two) reserve Contestants, i.e., for forty (40) Shows (episodes) one (1) Contestant shall be from Kaun Banega Crorepati 2 and the second (2nd) reserve Contestant shall be from Kaun Banega Crorepati 2007 series both these Contestants shall be from Mumbai or any other city as deemed fit by the Company for each Show who will be selected, contacted and arrangements made for his / her attendance on the Agreed Show Date in accordance with the procedures outlined above and who shall be entitled to take the place of Contestants in the event that the Show Dates for Contestants cannot be agreed and/or Contestants fail to attend on the Agreed Show Date and/or Contestants are excluded from the Studio Part of the Competition. The stand-by Contestant and his companion will be reimbursed only for the travel to and from their place of residence.
ROUND 4:
a) On the Agreed Show Date Contestants will be met at the Studio by a representative of the Company. Contestants will be required to sign an agreement in standard form for contributors to television programmes and shall include (i) their confirmation that they have understood and agree to the rules of the Competition and (ii) their consent to the recording of their contribution to the Show in question, and thereafter to the broadcast and all other audio visual exploitation of this and to the publication of his/her name and photograph in any media.
b) The rules and regulations with regard to the Studio Part of the Competition/prize and/or any other activities will be communicated and explained directly to the ten (10) Contestants by the Company at the Studio itself on the day of the recording of the Show.
PART B: GENERAL RULES
1. Employees of the Company, of the production house “Synergy Communications Pvt. Ltd.,” of the advertising agency, of “Synapse Information Services Pvt. Ltd.,” which has been appointed from time to time, and also employees of the main sponsors; and members of their immediate family; persons other than Indian nationals, or Indian nationals living out of India, or those who do not qualify under the definition of resident of India as per the Income Tax Act, 1961 or those not conversant in spoken Hindi, are ineligible to enter the Competition. Failure to provide proof or affidavit of eligibility, including the correct date of birth within a reasonable time upon request by the Company may result in disqualification and/or the withholding or withdrawal of a prize. The Company also reserves the right to disqualify a Contestant(s) incase a discrepancy is found to exist in the information furnished/provided/stated by the Contestant during the conversation with the Company and in the information(s) stated in the documents furnished by the Contestant(s).
2. Contestant is required to furnish necessary supporting documentation in original (i.e., birth certificate, school leaving certificate or passport) to confirm the eligibility of the Contestant(s).
3. While answering the question(s) in Round 1, Round 2 and/or Round 3 the Contestant(s) cannot repeat the question(s), incase the Contestant(s) repeats the question(s), the Contestant shall be immediately disqualified.
4. Incase the Contestant(s) answer is correct in Round 1, Contestant shall receive a call from the Company within three (3) days from the date of the lines of entries getting closed for that particular question.
5. The Company reserves the right to hold the Quota(s) in abeyance should there be insufficient correct entries in any category(ies) of the Quota(s). The Company also reserves the right to increase or decrease the ratio of the Contestants in each Show, i.e., increase or decrease the number of contestants from the Kaun Banega Crorepati 2 who can participate in a particular Show, which will lead to the increase or decrease the number of Contestants selected from Kaun Banega Crorepati (2007 series), without any prior intimation to the Contestants and/or the public.
6. The arrangement for the travel of the Contestants will be made by the Company as mentioned in the rules above. The Contestants who are residing in Mumbai shall be reimbursed by the Company on actuals.
7. Persons must enter the competition on their own behalf and entry(ies) by proxy will not be accepted.
8. Only the entries received after the question premiere’s on air will be considered valid.
9. The Company may in its sole discretion exclude a Contestant from participation in the Studio Part of the Competition which may include without limitation (i) circumstances which, in the Company’s view, renders the Contestant unfit to participate therein; (ii) inability to produce documentation specified by the Company proving the identity of the Contestant.
10. The Company may refuse to pay winnings or reclaim all sums paid to Show Players in the event of his/her fraud, dishonesty or non-entitlement to participate in the Competition under the Rules.
11. In the event of any fault, misunderstanding or dispute concerning any part of the Competition, and/or the operation of the telephone system, or the validity of any answer the decision of the Company shall be final.
12. The Company reserves the right to amend the Rules or terminate the Competition at any time and/or terminate the Competition without any prior intimation or notice to the public and also the Company is not obligated in any manner whatsoever to compensate any person or persons who have participated in the Competition and/or accommodate any person or persons who have been selected in the present series of the Competition in any further series of Kaun Banega Crorepati or any other program
13. All Contestants agree to abide by the Rules including these General Rules.
14. If the operation of the Competition (including without limitation the operation of the telephone system); the recording; broadcast of any/all of the Shows is prevented by an event of force majeure the Company may cancel all or any part of the Competition.
15. Whilst the Company shall make all reasonable endeavours to (i) enable Contestants to proceed with their ideal Show (ii) to contact all Contestants at each relevant juncture of the Competition the Company can make no guarantee therefore and the Company shall in its sole discretion be entitled to proceed with the next entitled Contestant under these Rules.
16. Notwithstanding a Contestant’s participation in the Competition there is no obligation on the part of the Company to broadcast any Show in which he/she has taken part, or any or all of his / her contribution as recorded by the Company.
17. Contestants can make it only once to the Fastest Finger First round for the Kaun Banega Crorepati 2007 series. Any Contestant who has made it once to the FFF round of the Competition of the Kaun Banega Crorepati (2007 series) series will not be eligible to participate in the Competition any more.
18. The Company has endeavored to make all reasonably practicable arrangements to minimise telephone system difficulties but can make no guarantee therefore.
19. Contestants will not be confirmed as finalists for the show if they are suffering from any kind of ill health, medical problems (viz.: heart problem, blood pressure problem, final stages of pregnancy, etc.). It is the responsibility of the Contestant to be medically cleared. Nevertheless the final decision regarding their participation in the Studio Part of the Competition rests entirely with the Company.
20. The Company reserves all rights to make amendments to the existing rules without prior notice. The Company shall not be responsible and/or liable in any manner whatsoever in case the Contestant(s) are unable to participate in the entry level process due to failure on the part of the telecom operator, facility provider, etc.
21. Non-conformance by any contestant and/or the Show Player to the rules of the Competition will disqualify them from participation or winnings, immediately, as the case may be.
22. The winner of the Competition agrees that he/she shall make himself/herself available from time to time and co-operate with the Company and participate in any activity and/or campaign (“Promotional Activity”) of any nature whatsoever without any money payable to the winner(s). Further, the Show Player(s) shall at no point of time refuse or disagree to participate in any such Promotional Activity for any reason whatsoever. The Show Player(s) agrees that the footage of any nature with regard to the winner(s) shall vest with the Company, including but not limited to all intellectual property rights and any other rights for worldwide and in perpetuity.
23. The winner(s) and/or the Contestant(s) of the Competition agrees that he/she shall hold harmless the channel, Company, its employees, officers or any other person in connection with the prize won by him/her and/or in relation to the Program including but not limited to the procedure in the Competition and shall also not file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India against sponsor and/or the channel/Company to claim any damages or reliefs.
24. The Company and/or the channel is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any physical injury, death, mental trauma caused to the contestant(s) and/or the winner (s) in any manner whatsoever, in relation to the Competition and/or prize.
25. The maximum prize which can be won in the Competition is Rs. 2 crores and any and all taxes and/or levies applicable under the laws of India shall be borne by the winner(s) in relation to the prize.
26. If Contestants are unclear as to the rules by sending a stamped and self addressed envelope to the following address: Kaun Banega Crorepati 2007,P.O. Box No.37454, J.B. Nagar Post Office, Andheri(E), Mumbai 400059. The Company shall endeavor to the best of it’s ability to respond thereto.
27. The cities/states covered as per the zones are as under for Quota-1:
Zone-1: Haryana, Himachal Pradesh, Jammu & Kashmir, Punjab, Chandigarh
Zone-2: Uttar Pradesh (East), Uttar Pradesh (West), Uttaranchal, Rajasthan
Zone-3: Delhi
Zone-4: Gujarat, Maharashtra,Goa, Diu & Daman
Zone-5: Mumbai
Zone-6: Madhya Pradesh, Chattisgarh
Zone-7: Bihar, Jharkhand, Orissa
Zone-8: NESA, West Bengal and Andaman Nicobar
Zone-9: Kerela, Tamil Nadu
Zone-10: Andhra Pradesh, Karnataka
28. The cities/states covered as per the zones are as under for Quota-2 and Quota 3
Zone A: Delhi, Haryana, Himachal Pradesh, Jammu & Kashmir, Punjab, Uttar Pradesh (East), Uttar Pradesh (West) and Rajasthan.
Zone B: Gujarat, Maharashtra, and Mumbai
Zone C: Assam, Bihar, Jharkhand, Kolkata, NESA, Orissa, West Bengal and Andaman Nicobar, Madhya Pradesh, Chhattisgarh.
Zone D: Andhra Pradesh, Chennai, Karnataka, Kerala and Tamil Nadu.
29. The Company reserves the right to re-schedule the date(s) of recording of the Studio Part of the Competition.
30. Save and except for the selection process as detailed up to clause a(i) stated in Round 3 herein, the rests of the Rules and General Rules shall be applicable and binding to the Contestants (from Kaun Banega Crorepati 2) who have been brought forward to participate in Kaun Banega Crorepati 2007 series.
31. In case the winner(s) (whether hot seat or FFF) is found to be in violation of any and all rules of the Competition, the Company reserves the right to initiate legal proceedings against such person(s) including but not limited to having the concerned winner (whether hot seat or FFF) to refund the prize money won on the Show together with penalty interest as deemed fit by the Company.
32. The courts of Mumbai have sole and exclusive jurisdiction.
